NYC DOB Rule Adoption: Penalty for Failure to Certify Correction of Immediately Hazardous Violations

Effective Date: December 18, 2024

Adopted Rule Summary

New York City has adopted a rule modifying penalties for property owners who fail to certify the correction of immediately hazardous violations. These changes, introduced under Local Law 50 of 2022 and Local Law 126 of 2021, amend section 28-219.1 of the New York City Administrative Code to refine the penalty system while providing exemptions for certain properties.

Key Changes Under Local Law 50/22:

  • Eliminates the **minimum** penalty for failing to certify corrections of hazardous conditions.
  • Exempts **1-4 family homes** from these penalties.
  • Limits fines to violations **at construction sites** involving serious hazards.

Additional Updates Under Local Law 126/21:

  • Property owners must **pay the civil penalty before** submitting a certificate of correction. The certificate of correction for the immediately hazardous violation giving rise to the civil penalty will not be approved until the penalty has been paid.
  • Ensures rule alignment with existing DOB procedures on penalty enforcement and challenges.

These updates establish a structured approach for enforcing safety violations while allowing property owners to contest penalties through the proper channels.
